01Who we are

Kuben Digital is a trade name of Kuben LLC, a limited liability company registered in the State of Wyoming, United States. In this document we refer to it as “Kuben Digital” or “we”, and to the person or business that purchases our services as “the client”.

02Services

We offer the following services, depending on the plan purchased:

• Design and development of websites in Spanish and English.
• Redesign of existing websites.
• Setup and optimization of the business's Google profile.
• Monthly maintenance: hosting, domain, security certificate, updates according to the plan, technical review and WhatsApp support.

The exact scope of each plan is the one published on our website at the time of purchase.

03Prices

All prices are in US dollars (USD) and do not include any taxes that may apply depending on the client's state. Each plan includes an upfront payment for the design and a monthly or annual maintenance fee.

Referral program: if you refer a business to us and that business purchases a plan, we credit you 1 month of your maintenance fee once they pay their first month. There is no limit on referrals. The credit cannot be exchanged for cash and is applied to your next charge. To count, the business must mention you when purchasing.

We may change our prices at any time. If a change affects a service you already have, we will notify you at least 30 days in advance.

04Payment

• The upfront payment is split into two parts: 50% when the project starts and 50% when the design is approved, before publication.
• The maintenance fee is charged in advance, automatically, starting on the date the site is published.
• With the annual plan you pay for 10 months and receive 12.
• Payments are processed by third-party providers such as Stripe. Kuben Digital does not store your full card details.

05Process and delivery times

The published delivery times (5, 7 or 10 days depending on the plan) are business days and start when we receive the initial payment and all the necessary information: text, photos, logo, services and hours. Delays in sending that information extend the delivery time accordingly.

Before publication, the client may request up to two rounds of revisions to the design presented. Additional changes, or changes that alter the agreed scope, may be quoted separately.

06Client responsibilities

• Provide accurate and up-to-date information about their business.
• Hold the rights to use the photos, logos and text they send us.
• Create, or give access to, any necessary third-party accounts, such as their Google profile, Calendly or Stripe, and complete any verification those platforms require.
• Review and approve the design within a reasonable time.

07Ownership of content and domain

The client keeps all rights to their brand, text, photos and domain. The domain is always registered in the client's name.

The site's design and code are created by Kuben Digital, which grants the client a license to use them while the maintenance service is active. If the client wishes to keep the site files when the service ends, they can purchase them with a one-time payment based on their plan: US$300 for Basic, US$500 for Professional and US$800 for Premium. If maintenance was active for 24 months or more, we deliver the files at no cost.

08Maintenance and updates

Each plan includes a number of updates per month: 1 on Basic, 3 on Professional and 4 on Premium. An update is a small change to content that already exists on the site: replacing a photo, a price, business hours, contact details or a short text (up to one paragraph). It is applied in Spanish and English within 2 business days of receiving the complete request.

The following are not updates and are quoted separately, with the price given before work starts: new pages or sections, new features (for example bookings, an online store or forms), redesigns and rewriting multiple texts. Paid advertising and social media management are not included either.

Unused updates do not roll over to the next month.

On the Premium plan, the 2 monthly Google profile posts and the review replies require the client to give us manager access to their profile. Review replies are written in a professional tone, and the client may ask us not to reply to any given review.

09Minimum term and cancellation

The maintenance service has a minimum term of 3 months from the date the site is published. After that, the client may cancel at any time, effective at the end of the period already paid. Details about refunds are in our Refund and Cancellation Policy.

10Non-payment

If a charge fails, we will let you know so you can update your payment method. If payment is not made within 15 days, the site may be temporarily paused and will be reactivated as soon as the balance is paid. If payment is more than 60 days late, we may end the service. In all cases, the domain remains the client's property.

11Third-party services

Our services rely on third-party platforms such as hosting and domain providers, Google, WhatsApp, Stripe and form tools. We are not responsible for outages, changes or failures of those platforms, although we will make reasonable efforts to resolve any issue.

12Results

We work to make your site professional, fast and easy to find. However, we cannot guarantee a specific position on Google or a particular number of customers, sales or inquiries, as these depend on factors outside our control.

13Limitation of liability

To the maximum extent permitted by law, Kuben Digital's total liability to the client for any claim related to the services is limited to the amount paid by the client during the 3 months before the event giving rise to the claim.

14Changes to these terms

We may update these terms. We will publish the current version on our website with its update date, and we will let you know if the changes affect your active services.

15Governing law

These terms are governed by the laws of the State of Wyoming, United States.
